Le 30 novembre 2011 lorsque sous l’activisme de Luis Moreno Ocampo, premier procureur de la CPI – Cour Pénale Internationale -, le pouvoir Ouattara transfère Laurent Gbagbo à la Haye, tous croient que le destin de cet homme est plié. Huit ans plus tard, il est blanchi de tous les crimes imputés. Mais coup de théâtre ! Il est toujours maintenu en détention après son acquittement total. Retour sur une harassante procédure judiciaire qui se termine par une prise d’otage de la CPI sur des personnes innocentes.
16 janvier 2019, 14h30 en temps universel (15h30 aux Pays-Bas), c’est l’heure de la fin du baroud d’honneur du substitut McDonald pour empêcher Laurent Gbagbo et son dernier ministre de la jeunesse Charles Blé Goudé de sortir de prison. La veille, la cour de première instance dans sa majorité a prononcé l’acquittement total avec libération immédiate des prévenus. Le juge italien Cuno Tarfusser confirme donc le verdict. La galerie du public remplie des partisans des deux leaders explose de joie.
Gbagbo : inocenté, libéré puis remis en prison
Les deux ex-prisonniers sont alors transférés de la CPI en attendant les formalités du greffe pour une sortie définitive de prison. Il est prévu qu’ils dorment à l’hôtel pour leur premier jour de liberté. Une commande de repas est faite, ils sont entourés de leurs avocats et de quelques proches. C’est le moment des pauses photos avec des visages resplendissants de joie.
Coup de tonnerre vers 20h, une information est transmise aux avocats.
Le procureur a fait appel de la décision de la chambre de première instance et les juges de la cour d’appel sans doute sortis de leurs obligations familiales demandent le retour en cellule des prévenus en attendant de statuer sur la requête du procureur qui sans véritablement rejeté l’acquittement de Gbagbo et de Blé Goudé demande à ce qu’ils ne regagnent pas la Côte d’Ivoire dans l’attente d’un éventuel procès en appel.
Les deux prévenus sont reconduits en cellule et y sont maintenus par une décision de la cour d’appel qui statuera sur la requête du procureur le 1er février 2019. Les observateurs et même les plus farouches détracteurs de Gbagbo tombent des nues. De l’histoire de la justice mondiale, il n’y a jamais eu de cas de figure pareil.
Une personne acquittée est empêchée de retrouver sa liberté et interdite de retrouver son pays. D’éminents juristes et défenseurs des droits se perdent en conjectures face à ce déni de justice, cette prise d’otages qui ne dit pas son nom. Il est désormais certain que la CPI est le problème dans la résolution définitive de la crise ivoirienne.
